We, at Zero Um Digital Serviços and Participação Ltda, a business entity registered under the CNPJ number 03.230.021/0001-9, hereby represented in accordance with its Social Statute, and Zero Um Digital Serviços Ltda, a business entity registered under the CNPJ number 15.335.154/0001-01, (“Zeroum” or “we”), have developed the Lottie Dottie Chicken App, a digital product created for children, their caregivers, and also teachers, containing videos, games, and books selected by experts, which can be accessed through various platforms.

This Privacy Policy describes how Zeroum uses the data that can be collected, directly or indirectly, from the users of the Lottie Dottie Chicken App.

Acceptance of this Privacy Policy (“Policy”) will be made when the user or, when necessary, their father, mother, or legal guardian, accesses the Lottie Dottie Chicken App and agrees, affirmatively, with the use of their personal data for each of the purposes described by us here. Zeroum will strive to respond to the request, provided that it does not infringe on trade secrets and/or intellectual property.

WITH WHOM CAN ZEROUM SHARE PERSONAL DATA?


Zeroum may collaborate with other companies in various activities, including data hosting, analysis, and sending communications. Whenever possible, we will adopt mechanisms for anonymizing data to preserve privacy to the maximum. Thus, we reserve the right to share personal data only with the companies mentioned below:

Suppliers: we employ other companies to perform work on our behalf and need to share your personal data with them to make the Lottie Dottie Chicken App available. For example, we use data hosting services to store our database and share your information with technology providers. Our suppliers are only authorized to use personal data for the specific purposes for which they were contracted, so they will not use your personal data for other purposes, beyond the provision of services contractually agreed upon.

Zeroum Partners: Zeroum may establish partnerships to provide its Services and, for that, can share users' personal data with these partners to enable the offering of products and services. To safeguard and protect Zeroum's rights: Zeroum reserves the right to access, read, preserve, and disclose any data that we believe to be necessary to comply with a legal obligation or a court order; enforce this Policy, the Terms of Use, and other agreements; or protect the rights, property, or safety of Zeroum, its employees, users, or others.

Affiliated Companies: Zeroum may transfer data between affiliated companies to improve Zeroum's services and products. All companies are subject to contractual obligations in which they commit to treat users' personal data with the same level of security and in accordance with applicable laws.

If Zeroum needs to delegate the provision of certain services (such as to a financial service provider, for example), the contracted third party will only receive the essential information to provide the corresponding service. It is the responsibility of the third party to ensure the protection of users' personal data.

Zeroum will not disclose your personal information to third parties, except in cases expressly mentioned in this Privacy Policy and in the following situations: (a) in response to subpoenas, court orders or legal processes, to the extent permitted and restricted by law; (b) when disclosure is essential to preserve the security and integrity of the applications, or to protect the safety of any user or other people, as required by applicable laws; (c) when the disclosure is directed or consented to by the registered member who provided the personal information; (d) in case of a business transition, such as a merger, divestment, acquisition, liquidation, or sale of all or part of the assets of Zeroum or any of its affiliated companies, where, in most cases, your personal information will be part of the transferred assets; or (e) in restricted circumstances, Zeroum may disclose your email address to comply with laws and regulations, including the Control of Pornography Attack and Unsolicited Marketing Law (CAN-SPAM Act of 2003).

DOES ZEROUM CONDUCT INTERNATIONAL TRANSFER OF PERSONAL DATA?


Yes. Although Zeroum is headquartered in Brazil and its products and services are directed at people in Brazil, subject to Brazilian personal data protection laws, the data we collect may be transferred to other countries around the world. This transfer occurs mainly for cloud hosting of Zeroum servers and the development of its products in collaboration with other contracted partner companies.

We suggest that you read carefully the privacy policies of these suppliers and business partners, as these may provide information about the exact location of their headquarters and servers.

By providing personal data to Zeroum, the user, or their father, mother, or legal guardian, consents to the processing and international transfer of these data to the United States of America. This information may be subject to local legislation and applicable regulations.

WHAT ARE THE USERS' RIGHTS AS DATA HOLDERS?


The user always has the option to choose not to provide their personal data to Zeroum, although these data may be essential to enjoy certain features of the Lottie Dottie Chicken App. Regardless of this, the user maintains their rights related to privacy and the protection of their personal data. Zeroum is committed to the security of these data and aims to ensure that its users are aware and have access to all pertinent rights regarding the treatment of personal data.

Request for anonymization, blocking or deletion of unnecessary, excessive personal data or data processed in non-compliance with the legislation: This right allows the request for anonymization, blocking or deletion of personal data from Zeroum's database. All collected data will be anonymized, blocked, or deleted from the servers when requested or when they are no longer necessary or relevant for the provision of services, except if there is any other reason for their maintenance, such as the possible need to retain the data to comply with a legal obligation or to safeguard Zeroum's rights.

  5. Request for portability: Zeroum allows the user or third parties nominated by them, to gain access to the personal data processed by Zeroum in a structured and interoperable format.

  6. Right not to provide or withdraw consent at any time: The user has the right not to provide or withdraw their consent, however, this will not affect the legality of any processing previously carried out. If the user does not provide or withdraws their consent, Zeroum may not be able to provide certain products and services. And, if this is the case, Zeroum will inform the user when this occurs.

  7. Right to review automated decisions: The user also has the right to request a review of decisions made solely based on automated processing of personal data that affect the users' interests.

  8. Right to object to certain data processing: The user also has the right to object to certain purposes of processing. In some cases, Zeroum may demonstrate that it has legitimate reasons for processing the data, which override the user's rights, for example, if they are strictly essential for the functionality of the products or services.


It may be necessary to ask for specific information from the user, their father, mother, or legal representative, in order to verify their identity and ensure the right to access their personal data (or exercise other rights). This precaution is a security measure intended to ensure that the data is not disclosed to anyone who does not have the right to receive them.

Zeroum will endeavor to respond to all legitimate requests within 5 business days for correction requests and 15 business days for other requests. In exceptional situations, when the request is particularly complex or if the user has made several requests, the process may take more than 15 business days. In this case, we will notify the holder and keep them informed about the progress of the request.

HOW LONG WILL USERS' PERSONAL DATA BE STORED?


Zeroum will retain the users' personal data only for the period necessary to fulfill the purposes for which they were collected, which includes the fulfillment of legal obligations (such as the storage of access records to the application for 6 months, as provided in the Marco Civil da Internet), contractual, accountability, or responding to requests from competent authorities.

When defining the appropriate retention period for personal data, Zeroum considers the amount, nature, and sensitivity of these data, the potential risk of harm from unauthorized use or disclosure, the purpose of processing and whether these purposes can be achieved by other means, as well as the applicable legal requirements.

Regardless, if you have created an account on the Lottie Dottie Chicken App, the information associated with your account will be retained while the account is active. If you do not log in for a period of 5 years, your account and corresponding information will be deleted. Furthermore, if you request the deletion of your data and/or account, Zeroum will maintain them for an additional 15 days after receiving your deletion request.

It is important to note that Zeroum may retain personal data for a period longer than mentioned above to comply with applicable legal obligations, as stipulated by relevant legislation, including consumer and tax law norms.

HOW DOES ZEROUM PROTECT USERS' DATA?


Zeroum implements technical, administrative, and organizational measures to safeguard users' personal data against loss, unauthorized use, or any other form of misuse. These data are stored in a secure operational environment that is not accessible to the public.

Zeroum strives to preserve the privacy of the account and other personal data of registered users, although, unfortunately, failures may occur, regardless of the best information security practices implemented by Zeroum. Unauthorized entry or use of accounts, hardware or software failures, and other factors can compromise the security of personal data at any time. Therefore, it is crucial that users assist Zeroum in maintaining a secure environment for everyone. Lottie Dottie Chicken App is a subscription service that offers access to cartoons, books, audiobooks, activities, games, music, and videos.

Acceptance of Terms of Use
By using the services of Zeroum, you accept and agree to these Terms of Use. If you do not agree with the Terms of Use, do not use the Lottie Dottie Chicken App.

The company Zeroum that is providing services to you (referred to as "Zeroum" in these Terms of Use) and with whom you are entering into this agreement depends on the country where you initiate the service subscription.

Changes to Terms of Use
Zeroum reserves the right to make changes to these Terms of Service regularly, including the Privacy Policy. Such modifications will take immediate effect, but for existing subscribers, will only come into effect 30 days after their publication, unless otherwise indicated.

Subscription, Free Usage Period, Charges, Refunds, and Cancellation
Subscription. Subscriptions to the applications can be acquired in various ways. In all of them, it is the exclusive responsibility of the subscriber to keep the email, the subscription identifier, as well as when contracting the service, the subscriber declares and guarantees, expressly, to have legal capacity to carry out such a subscription, and that all the information provided by them in the contracting of the service are true and correct in all respects. Zeroum is not responsible, in any way, for subscriptions made according to the procedure established here, nor for the information provided, for which you are the only responsible, whether for the truthfulness or for the conformity of the same and the fulfillment of the conditions described here.

Subscription through App Store
Subscriptions made through the app store of your device use the corresponding payment system of that store. Therefore, these subscriptions are subject to the Terms and Conditions of your device's operating system. Depending on the manufacturer, the operating system may allow developers to access information about the subscription through the email used for it or the order number. Thus, to obtain information about this subscription, cancellation, or refund, it is the responsibility of the subscriber to keep these data (and other relevant data referring to the subscription) to be able to verify with the corresponding app store of their operating system or contact Zeroum support.

Subscription through Telephone Operator
Subscriptions made through the telephone operator are the exclusive responsibility of the respective operators. To obtain information related to this subscription, including cancellation or refund, it is the responsibility of the subscriber to keep recorded the area code along with the phone number used to make the subscription. Any necessary assistance should be sought with the operator's support.

Gift Card
Subscriptions to Zeroum's applications can be acquired through gift cards offered or sold by our partners or through Zeroum promotions. This type of subscription is activated through a code. As it is a gift, we do not offer cancellation or refund for this type of subscription. It is important to note that these codes have a maximum period to be activated and, after this period, they become invalid, and it is not possible to obtain a new code. For clarifications about the code you received, contact Zeroum support through the link 01digital.zendesk.com and provide the code in question.

Subscriptions may have automatic renewal or not
Refund for subscription made through the device's app store. Subscriptions made through the device's app store use the payment system of the device itself. The subscriber has the right to withdraw from the Zeroum subscription in accordance with the Consumer Protection Code. In this case, the full amount paid will be refunded directly in the form of payment used. After this period, for any reason, the decision to grant or not the refund is at the discretion of Zeroum, subject to analysis of the case. To request a refund, the subscriber must provide the necessary information, such as the email or the order number of the subscription. Refund for subscription made through the telephone operator
The subscriber has the right to withdraw from the Zeroum subscription in accordance with the Consumer Protection Code. In this case, the full amount paid will be refunded through recharge for prepaid lines or deposit into a checking account for postpaid lines. After this period, for any reason, the decision to grant or not the refund is at the discretion of Zeroum, subject to analysis of the case. To request a refund, the subscriber must provide the necessary information, such as the area code + the phone number used to make the subscription. Refund for subscription of gift card
There is no refund for this case.

Cancellation of subscription made through the App Store
As mentioned earlier, subscriptions made through the App Store use the payment system of Apple. To cancel the subscription, we recommend following the instructions provided by Apple, available at https://support.apple.com/pt-br/HT202039.

Cancellation of subscription made through Google Play Store
Subscriptions made through this store use the payment system of Google. Therefore, to cancel automatic renewal, it is recommended to use the system provided by Google. Detailed instructions for cancellation can be found at https://support.google.com/googleplay/answer/7018481

Cancellation of subscription made through the telephone operator
To stop automatic renewal, send a message with the word EXIT to the number from which you receive messages. This number varies depending on your operator. In case of doubts or to obtain specific information, contact the operator directly.

Cancellation of subscription made through Giftcard
There is no cancellation for this type of subscription.

After cancellation and the end of the payment period, the user's access to the exclusive subscriber content of the Lottie Dottie Chicken App will be completely blocked. This includes access to previously downloaded content.

Lottie Dottie Chicken App Services
To become a subscriber of the Lottie Dottie Chicken App, you must be 18 years of age or older, or be considered of legal age according to the laws of your state, territory, or country. Those under 18 years of age or the applicable age of majority may only use the service under the supervision and involvement of a parent or guardian. In this case, the use must occur through the parent's or guardian's account, following the established Terms of Use.

The Lottie Dottie Chicken App and all content viewed through it are intended exclusively for personal and non-commercial use. During the period of your subscription, Zeroum grants you a limited, non-exclusive, and non-transferable license to access the service, including cartoons, music, books, audiobooks, activities, videos, and games, exclusively through the apps and services of the Zeroum platform. You agree not to use the service for public displays.

You may access the content of the Lottie Dottie Chicken App primarily in the country where you have registered and only in geographical areas where we offer our service and have licensed such content. The availability of content may vary by geographic location. We reserve the right to add or remove content from one or more countries at any time.

Using Zeroum sites and applications in another country may result in differences in available content. Therefore, it is not possible to download content from a different country than the one where you are currently using the app or service. If you wish to do this, it is necessary to download the content beforehand, before using the products in a different location.

Part of the content of the Lottie Dottie Chicken App is available for download and offline viewing on devices compatible with the service. The availability of content for offline viewing may vary according to contracts and licenses established with content partners. In our services, the contents that can be downloaded for viewing without an internet connection are clearly identified. To watch any content offline, it must first be downloaded while connected to the internet. Only after downloading, the contents can be accessed and used without an internet connection.

The number of devices on which you can use the Lottie Dottie Chicken App services simultaneously is unlimited. You may use the same subscription on all these devices, as long as you log in to your account associated with the corresponding app stores.

The quality of the image, startup time, and performance of the Lottie Dottie Chicken App services may vary according to various factors, including your location, available bandwidth, the speed of your internet connection, and technical aspects of your device, such as memory or processing capacity. Zeroum makes no representations or warranties regarding the quality of the image on your screen or the quality of the apps and services installed on your device.

Updates and Downloads
To keep the services offered by Zeroum up-to-date, it is your responsibility to go to the store where you downloaded the service (Google Play Store or App Store) and perform updates to access the latest content. Moreover, if you wish to enjoy any service from Zeroum, it is also your responsibility to go to the appropriate store (Google Play Store or App Store, depending on your device) and make the download.

Zeroum does not take responsibility nor guarantee the performance of our services on your devices, including the continuous compatibility of the device with our service. If you do not log out or deactivate the device, other users may access the Zeroum service through your account, obtaining access to specific information about your account. The products and content offered by Zeroum may vary according to the operating system and its version. Consequently, different devices may have access to different parts of the service, depending on the specifications and compatibility with the platform and version of the operating system.

By using the Lottie Dottie Chicken App, you agree to comply with all applicable laws, regulations, and codes, as well as the restrictions on the use of the service and the content set forth therein. You commit not to archive, download (except in cache for personal use), reproduce, distribute, modify, display, publish, license, or create derivative works, sell, or use the content and information from Zeroum services without the express written authorization of Zeroum and its licensors.

You are also prohibited from sending material intended to interrupt, destroy, or limit the functionality of software, hardware, or telecommunications equipment associated with Zeroum services. You agree not to reproduce, distribute, or alter the trademark of Zeroum and its partners without prior authorization.

Zeroum reserves the right to terminate or restrict your use of the service, without notice or compensation, if there is suspicion of a breach of any term in these Terms of Use or involvement in illegal or improper use of the service.

Passwords and Account Access
You are responsible for the security of your account; therefore, do not share your credentials with third parties to avoid unauthorized access. Additionally, it is your responsibility to keep the information associated with your Lottie Dottie Chicken App account updated and accurate.

Exercise caution regarding communications that request the sending of credit card data or other information related to your account. Responding to such communications with personal information can result in the theft of your data. It is your responsibility to keep the access information of your Zeroum Account (email and password) in mind, as it is only through this account that you can enjoy your subscription on various devices.
Terms of disclaimer of warranties and limitations of liability

The apps services of Zeroum, as well as all associated contents and software, are provided "as is" and "as available," without any kind of warranty. Zeroum makes no representations or warranties that the use of the service will be continuous or error-free. Zeroum specifically disclaims any liability for the use of the apps contrary to these Terms of Use.

To the fullest extent permitted by law, in no event shall Zeroum, its subsidiaries, affiliates, shareholders, directors, officers, employees, or licensors be liable (jointly or severally) to you for any special, incidental, indirect, or consequential damages of any kind, or any damages whatsoever.
Certain jurisdictions may not allow the exclusion of certain warranties or the limitation or exclusion of certain types of damages. Therefore, some of the limitations in this section may not apply to you.

No provision in these Terms shall affect any legal right that is provided to you. If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

Applicable Legislation
If you are a resident of Brazil, these Terms of Use shall be governed and interpreted according to Brazilian law.
